Punishment should be fixed or circumstantial ?

Some people believe that there should be fixed punishment for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motication for committing it, should always be taken into account when deciding on the punishment.

Discuss both these views and give your own opinion.


Given that the criminal rate increasing considerately in the recent years, the disagreement as to whether the fixed penalty should be set up or not has been the hot button issue. The valid arguments to the contrary are as follow.

On the one hand, the establishment of stable and clear punishment woud benifit individuals and the society at large. Firstly, along with the disapperence of vegue border between crime and self-defence rights, average people would restrict their behavior better as well as protect themselves with the help of law more effectively and efficiently. Further more, the potential criminals would think twice as the clear regulance and stringent punishment could be neglected and escape from impossiblely. In addition, the percentage of inaccurate judgement would descrease essentially for the fixed penalty regardless of the sway of media and consideration of unstable and emotional humanity.

On the other hand and more importantly, the law and crime are not as simple as some kinds of idiol questions,such as "Ture or False". Speaking from the faith of law,the fixed punishment could be a dream but nothing

--variety of offences need further evaluation and investigation. For example, a killer for self defense is quiet different from the series killers who kill victims just for satisfying personal emotion and preference. Admittedly ,the fixed punishment would offer incredible convenience for court judgement and decrease the influence of the press in some extend. Nonethless ,the noble and loyal law should base on the respect of humanal rights and lives. In other words, no matter how tought it may be ,every crimial case deserves deeper obervation in which taking account of commited motivation offers great help.

By way of conclusion, a flexible and humanal penalty far overweigh the fixed one. And taking the criminal motivation into consideration features the civilized and enlightend society we living in.
