A sub-contracted employee - business Law

I am looking for some one to help me

I have a question that states "an employee was sub-contracted out to another company and has been using materials and resources of the client company for his personal use without paying for it.

I have to identify if james is in breach of his contract?
And if a cliam is viable against the Company by the client for the resources the employee used?
